Terms & Conditions

Effective Date: January 1, 2025

These General Terms & Conditions (“Terms”) govern all services, products, and transactions provided by protenza 3D printing & design (“we,” “us,” or “our”). By placing an order, submitting files, approving a quote, or using our services, you (“the Client”) agree to be bound by these Terms.

1. Services

We provide 3D printing, design, prototyping, modeling, and related production services based on client-supplied specifications or mutually agreed designs.

All services are provided on a best-effort basis and may involve minor variations inherent to additive manufacturing processes.

2. Quotes & Pricing

  • Quotes are valid for 30 days unless otherwise stated.

  • Pricing is based on material, machine time, labor, finishing, and complexity.

  • Additional revisions, design changes, or scope increases may result in additional charges.

  • Prices do not include shipping, taxes, duties, or customs fees unless specified.

 

3. Payment Terms

  • Full payment or an agreed deposit is required before production begins.

  • Final files or physical products may be withheld until payment is received in full.

  • Late payments may result in delays, storage fees, or order cancellation.

 

4. Client Responsibilities

The Client is responsible for:

  • Providing accurate files, measurements, and specifications

  • Ensuring designs are functional, safe, and suitable for their intended use

  • Confirming ownership or licensing rights to all submitted designs

We are not responsible for errors caused by incorrect or incomplete client-provided information.

 

5. Design Approval & Revisions

  • Client approval of designs, proofs, or samples constitutes authorization to proceed.

  • Once approved, changes may incur additional costs and extended timelines.

  • We are not liable for errors present in approved designs.

 

6. Intellectual Property

  • All client-submitted designs remain the Client’s intellectual property.

  • By submitting designs, the Client grants us a limited license to use files solely for production purposes.

  • We retain ownership of any original designs, tooling, or files created by us unless otherwise agreed in writing.

 

7. Confidentiality

All client files, designs, and project details are treated as confidential and will not be shared without written consent, except as required by law.

 

8. Production Tolerances & Variations

Due to the nature of 3D printing:

  • Minor dimensional variances, surface imperfections, layer lines, and color differences may occur

  • Printed parts may not be identical to digital models or previous prints

  • Such variations do not constitute defects

 

9. Cancellations & Refunds

  • Orders may be cancelled prior to production start, subject to administrative or design fees.

  • Once production has begun, orders are non-refundable.

  • Custom and made-to-order items are not eligible for return except in cases of our error.

 

10. Shipping & Risk of Loss

Shipping terms are governed by our Shipping Policy.
Risk of loss transfers to the Client once the order is handed to the shipping carrier.

 

11. Warranty Disclaimer

Unless expressly stated in writing:

  • All products are provided “as-is” and “as available”

  • We make no warranties, express or implied, including fitness for a particular purpose or merchantability

3D printed products are not certified for safety-critical, medical, aerospace, or load-bearing applications unless explicitly stated in writing.

 

12. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages

  • Our total liability shall not exceed the amount paid for the specific order giving rise to the claim

 

13. Indemnification

The Client agrees to indemnify and hold us harmless from any claims, damages, or losses arising from:

  • Client-supplied designs or specifications

  • Intellectual property infringement

  • Improper use or modification of printed products

 

14. Compliance with Laws

The Client is responsible for ensuring that the use of products complies with all applicable laws, regulations, and industry standards.

 

15. Force Majeure

We are not responsible for delays or failures due to events beyond our reasonable control, including but not limited to natural disasters, equipment failure, supply shortages, or carrier delays.

 

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ontario, canada, without regard to conflict of law principles.

 

17. Modifications

We reserve the right to modify these Terms at any time. Updated Terms will apply to all new orders placed after the effective date.

 

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
